2. Text-Messaging Program
The The Lawyer James Messaging Program is operated by The Lawyer James J. DeCristofaro, Esq., P.C.
By voluntarily opting into text messaging, you authorize the firm to send text messages to the mobile telephone number you provide.
Non-marketing messages may include:
- Responses to inquiries;
- Consultation scheduling and confirmations;
- Appointment reminders;
- Intake instructions;
- Requests for documents or information;
- Matter or case-related updates;
- Billing or account notifications; and
- Other communications concerning requested or existing legal services.
If you separately consent to marketing messages, those messages may include general legal information, firm news, service updates, invitations, and information concerning the firm’s legal services.
Consent to receive marketing text messages is not required as a condition of obtaining legal services from the firm.
3. Message Frequency and Charges
Message frequency varies depending on your communications with the firm, the services you request, and the nature of the matter.
Message and data rates may apply to messages sent to you by the firm and messages you send to the firm. Contact your wireless carrier with questions concerning your text or data plan.
4. Opting Out
You may cancel text messages at any time by replying STOP to a message from the firm.
After you reply STOP, the firm may send one final text message confirming that you have been unsubscribed. You will then receive no additional text messages through that messaging program unless you subsequently enroll again or otherwise provide renewed consent.
The firm will also honor other reasonable communications clearly requesting that text messages stop.

6. Wireless Carrier Disclaimer
Wireless carriers are not responsible or liable for delayed, failed, incomplete, or undelivered messages.
Delivery of text messages is subject to effective transmission by your wireless carrier and is outside the firm’s complete control.
7. Telephone-Number Authorization
By enrolling, you represent that you are the subscriber or customary user of the telephone number provided and that you are authorized to consent to receiving messages at that number.
You agree to notify the firm or opt out if the number is reassigned, disconnected, or no longer used by you.
8. Confidentiality and Time-Sensitive Matters
Text messaging may not be secure. Do not use text messages to communicate highly sensitive or confidential information unless specifically instructed to do so by the firm.
Do not use text messaging for emergencies, court deadlines, statutes of limitation, filing deadlines, appearances, or other time-sensitive legal matters. Sending a text message does not establish that the firm received, reviewed, accepted, or agreed to act upon the information contained in the message.

Mobile information will not be shared with third parties or affiliated organizations for their marketing or promotional purposes. Text-messaging enrollment information and consent records will not be disclosed to third parties except service providers that assist the firm in operating and delivering its text-messaging services.
10. Changes or Termination
The firm may modify these Terms and Conditions or discontinue all or part of its messaging program at any time. Updated terms will become effective when posted on this website, unless applicable law requires otherwise.
